After a successful run as Cara Dune in Disney’s ‘The Mandalorian,’ Gina Carano is making headlines for a different reason. The well-known actress is suing Disney over what she claims was an unjust dismissal from the franchise.

Carano’s departure came after a series of controversial social media posts, where she compared anti-vaxxers to Jews and addressed other sensitive issues that clashed with modern sensibilities and Disney’s image. Although officially, her contract was not renewed, many view it as a firing.

This resulted in a lawsuit reportedly funded by Elon Musk, who pledged to support employees who feel discriminated against due to their worldviews. Carano is suing Disney for $75,000 and is seeking reinstatement at Lucasfilm.

Disney filed a motion to dismiss the case, but it was recently denied. California-based Judge Sherilyn Peace Garnett ruled that Disney failed to demonstrate that they hire contractors specifically to uphold a positive public image.

Defendants have not identified any evidence—in the Complaint or otherwise—to substantiate a claim that they employ public-facing actors for the purpose of promoting the ‘values of respect,’ ‘decency,’ ‘integrity,’ or ‘inclusion. […] Accordingly, Defendants’ invocation of the supposedly detrimental effects of Plaintiff’s ‘mere presence’ as one of Defendants’ employees lacks constitutional import.

At this stage in the litigation, the Court cannot conclude, as Defendants urge it to, that Plaintiff’s continued employment by Defendants would inhibit or intrude upon Defendants’ rights to expressive association.

With the lawsuit now heading toward a trial or settlement, Carano couldn’t be more pleased. In a recent social media post, the actress expressed that she was “moved to tears” by the latest legal developments.

What happened to me was unacceptable, absurd and abusive, among other things. It should not have happened to me, and it should not happen to anyone else moving forward. Let it stop here. I quite literally fought to get to where I got to in my career through intense ups and downs, and I’ll keep up that fight to continue doing what I love. I appreciate all of you who stood by me and defended me, and I am so sorry that similar situations have happened to some of you. I want you to know that I see you and I stand with you.

The actress went on to express her deep gratitude to Elon Musk for giving her the opportunity to pursue legal action against Disney.

Thank you to @elonmusk , a man I have never even met, who so graciously gave me a fighting chance. Thank you for standing for justice for all of humanity. May God bless you and your family for years to come because He has chosen you for such a time as this.

Carano still faces a lengthy legal battle ahead; this is just a small victory in the grand scheme. However, the court’s acknowledgment of her right to sue her former employer is a significant step forward.
